This Disclaimer supplements our Terms of Service and Privacy Policy. It applies to your use of the NexaraGrowth software-as-a-service CRM platform (the "Service"). By using the Service, you acknowledge and agree to the disclaimers below. Nothing on this page or elsewhere in the Service constitutes legal, financial, tax, or professional advice.

NexaraGrowth is a set of software tools for finding leads, managing a pipeline, dispatching jobs, running outreach campaigns, and reporting on your business. We do not guarantee any specific business outcome, including but not limited to:

• The number or quality of leads discovered or generated;
• Response, conversion, close, or retention rates;
• Revenue, profit, job volume, or growth of any kind;
• Review counts, ratings, or reputation outcomes; or
• Uptime or availability of any given feature beyond what is stated in your plan.

Past performance by NexaraGrowth or any other customer is not a guarantee or prediction of future results. Your results depend on many factors we do not control, including your industry, market, pricing, sales process, staffing, and how promptly and effectively you follow up with leads.

Certain features rely on third-party data sources (such as Google Places/Maps business listings) or AI-generated content and scoring (including drafted messages, lead scores, call transcripts, and summaries). This data and content may be incomplete, outdated, or inaccurate. You are responsible for reviewing and verifying any AI-generated or third-party-sourced content before relying on it or sending it to a customer or lead.

NexaraGrowth provides the technology to send SMS messages, place calls (including through an AI voice agent), and send emails to contacts you manage. NexaraGrowth does not, and cannot, verify that you have obtained proper consent to contact any individual, or that a given campaign complies with the Telephone Consumer Protection Act (TCPA), CAN-SPAM Act, state telemarketing and privacy laws, or carrier messaging policies. You are solely responsible for:

• Obtaining and documenting proper consent before texting or calling any contact;
• Configuring and honoring opt-out/STOP requests and suppression lists;
• The content, timing, and frequency of your campaigns; and
• Any fines, penalties, statutory damages, or legal claims arising from your outreach.

Any compliance summaries, checklists, or state-by-state reference material provided within the Service (including the Compliance dashboard) are provided for general informational purposes only, are not exhaustive, and do not constitute legal advice. Laws change frequently and vary by jurisdiction. You should consult a licensed attorney in your jurisdiction regarding your specific compliance obligations before relying on any information in the Service.

Payment collection features are provided through our processor, Stripe. NexaraGrowth is not a bank, money transmitter, or financial advisor, and does not guarantee the outcome of any transaction, payout timing, or dispute resolution handled by Stripe or your bank.

To the maximum extent permitted by law, NexaraGrowth disclaims all liability for business losses, missed opportunities, or damages arising from reliance on Service outputs, AI-generated content, or third-party data, as further described in Section 11–12 of our Terms of Service.

This Disclaimer is governed by the laws of the State of Iowa, consistent with the governing law provision in our Terms of Service.
